Terms of Service

The terms and conditions governing your use of Deploy Forge.

Definitions

Throughout these Terms, the following definitions apply:

  • "Service" — The Deploy Forge platform, including its website, dashboard, APIs, webhooks, and all related services.
  • "Content" — Any code, themes, plugins, files, data, or other materials you upload, deploy, or transmit through the Service.
  • "User," "you," "your" — Any individual or entity that accesses or uses the Service.
  • "Workspace" — A collaborative environment within the Service where one or more Users manage sites, deployments, and team members.
  • "We," "us," "our" — Deploy Forge and its operators.

Agreement to Terms

By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Deploy Forge. Please read them carefully before using the Service.

Description of Service

Deploy Forge provides a platform for automated deployment of WordPress themes and plugins from GitHub repositories. The Service includes:

  • Automated Deployments — Push-to-deploy from GitHub repositories to WordPress sites
  • Site Management — Connect and manage multiple WordPress installations
  • Deployment History — Track deployment status, view history, and perform rollbacks
  • Automatic Backups — Every deployment creates a backup of the previous theme or plugin version on your WordPress site
  • GitHub Integration — GitHub App installation and webhook-based continuous deployment
  • Workspaces — Collaborative team environments with role-based access control for managing sites and deployments together
  • Secure Webhooks — Authenticated communication between your WordPress sites and the Service

Account Registration

To use Deploy Forge, you must:

  1. Provide accurate, current, and complete registration information
  2. Maintain the security of your account credentials
  3. Be at least 18 years of age or the age of legal majority in your jurisdiction
  4. Accept responsibility for all activities that occur under your account
  5. Not share your account credentials or allow others to access your account

You may authenticate using email/password or through OAuth providers (GitHub, Google). You are responsible for maintaining the confidentiality of any authentication credentials. You must notify us immediately at security@getdeployforge.com if you suspect unauthorized access to your account.

Workspaces and Organizations

Creating and Managing Workspaces

Workspaces allow multiple Users to collaborate on site management and deployments. The User who creates a workspace is designated as the workspace Owner.

Roles and Responsibilities

  • Owner — Full administrative control, including billing management, member management, workspace deletion, and ownership transfer.
  • Admin — Can manage sites, deployments, and invite or remove members, but cannot delete the workspace or transfer ownership.
  • Member — Can view sites and deployments and trigger deployments within the workspace.

Workspace Owner Responsibilities

The workspace Owner is responsible for:

  • Ensuring all workspace members comply with these Terms
  • Managing workspace billing and subscription payments
  • Controlling access and removing members who violate these Terms
  • The Content deployed by workspace members through the workspace

Member Conduct

Each workspace member is individually responsible for their own actions within a workspace, including the Content they deploy and their compliance with the Acceptable Use policy.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of others
  • Upload, transmit, or deploy malicious code, malware, or harmful content
  • Attempt unauthorized access to our systems or other Users' accounts
  • Interfere with or disrupt the integrity or performance of the Service
  • Engage in any form of automated data collection (scraping, crawling) without permission
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service for fraudulent or deceptive purposes
  • Circumvent any access controls or usage limits
  • Resell, redistribute, or sublicense the Service without written permission

Violation of these terms may result in account suspension or termination as described in the Termination section below.

API and Webhook Usage

Webhook Endpoints

The Service communicates with your WordPress sites via authenticated webhooks. You agree to:

  • Maintain valid and accessible webhook endpoints on your WordPress sites
  • Not interfere with or tamper with webhook authentication mechanisms
  • Keep the Deploy Forge WordPress plugin up to date on connected sites

Rate Limits

We may impose rate limits on API requests and webhook deliveries to ensure Service stability. Current rate limits are documented in our documentation. Exceeding rate limits may result in temporary throttling of your requests.

Programmatic Access

Any automated or programmatic access to the Service must comply with these Terms. We reserve the right to block automated access that degrades Service performance for other Users.

Intellectual Property

Our Property

Deploy Forge, including its original content, features, functionality, and branding, is owned by Deploy Forge and protected by copyright, trademark, and other intellectual property laws. You receive a worldwide, non-exclusive, non-sublicensable, and non-transferable license to use the Service solely for its intended purpose.

Your Content

You retain ownership of all code, content, and data you deploy through the Service. By using Deploy Forge, you grant us a limited license to host, process, and transmit your Content solely as necessary to provide the Service. We do not claim ownership of your WordPress themes, plugins, or other deployed assets.

Open Source and Third-Party Licenses

You are solely responsible for ensuring that the Content you deploy complies with all applicable open source licenses (including the GPL, which governs many WordPress themes and plugins) and third-party license terms. Deploy Forge does not verify license compliance of deployed Content.

DMCA Compliance

We respect intellectual property rights and respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

If you believe that Content deployed through the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent at legal@getdeployforge.com. Your notice must include:

  1. A description of the copyrighted work you believe has been infringed
  2. A description of the material you believe is infringing and its location
  3. Your contact information (name, address, email, phone number)
  4. A statement that you have a good-faith belief that the use is not authorized
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

Counter-Notification

If you believe your Content was wrongly removed due to a DMCA notice, you may submit a counter-notification to legal@getdeployforge.com with the required information as specified by the DMCA.

Payment Terms

Payment Processing

All payments are processed through Polar (polar.sh), our third-party payment provider, who acts as the Merchant of Record for all transactions. By subscribing to Deploy Forge, you also agree to Polar's terms of service.

Subscription Plans

  • Subscriptions are billed in advance on a monthly basis
  • All fees are in US Dollars
  • Prices are subject to change with 30 days advance notice
  • You are responsible for any applicable taxes

Recurring Billing

By subscribing, you authorize recurring charges to your payment method. Charges will continue automatically until you cancel your subscription through your account settings or the Polar customer billing portal.

Cancellation

  • You may cancel your subscription at any time from your account dashboard
  • After cancellation, your subscription access remains active through the end of your current billing period
  • No partial refunds will be issued for unused portions of a billing period

Refunds and Billing Disputes

Fees are generally non-refundable. However, if you believe you have been charged in error or an unauthorized charge has been made, contact us at billing@getdeployforge.com within 30 days of the charge. We will review billing disputes on a case-by-case basis and issue refunds where appropriate. You may also contact Polar directly through their customer billing portal to dispute a charge.

Third-Party Services

Dependencies

The Service relies on third-party services including GitHub (for repository access and webhooks), your WordPress hosting provider (for site connectivity), and Polar (for payment processing). We are not responsible for the availability, performance, or policies of these third-party services.

Your Responsibilities

You are responsible for:

  • Maintaining active and properly configured GitHub repositories and installations
  • Ensuring your WordPress sites are accessible and running compatible versions of the Deploy Forge plugin
  • Complying with the terms of service of GitHub, your WordPress hosting provider, and any other third-party services you use in connection with Deploy Forge

Third-Party Outages

Disruptions to third-party services (such as GitHub outages or WordPress hosting downtime) may affect the availability of certain Service features. Such disruptions are not considered a breach of these Terms by Deploy Forge.

Service Availability

We strive to maintain high availability of the Service, but we do not guarantee any specific uptime percentage or service level. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

Limitation of Liability

Important: Please read this section carefully as it limits our liability to you.

To the maximum extent permitted by applicable law, Deploy Forge and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Service interruptions or downtime
  • Errors in deployed content or failed deployments
  • Third-party service outages (GitHub, WordPress hosting, payment processing)
  • Actions or content of other workspace members
  • Any damages arising from your use of the Service

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) one hundred US dollars ($100) or (b) the total amounts you paid to us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Important: The Service is provided without warranties.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant that deployments will succeed or that backups will be complete or recoverable in all circumstances.

Indemnification

You agree to indemnify, defend, and hold harmless Deploy Forge and its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights (including intellectual property and open source license terms)
  • Content you deploy through the Service
  • Actions of members within workspaces you own or administer

Dispute Resolution, Arbitration, and Governing Law

Important: This section affects your legal rights. Please read it carefully.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.

Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at legal@getdeployforge.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in accordance with its Comprehensive Arbitration Rules. The arbitration shall take place in San Francisco, California, USA, or at another mutually agreed location.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class actions, class arbitrations, or representative actions.

Jury Trial Waiver

You waive any right to a jury trial in any dispute arising under these Terms.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@getdeployforge.com within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

Termination

By You

You may terminate your account at any time by canceling your subscription and deleting your account through the dashboard.

By Us

We may suspend or terminate your account with reasonable notice for the following reasons:

  • Material violation of these Terms (we will provide notice and a reasonable opportunity to cure where practicable, except in cases of fraud, illegal activity, or threats to Service security)
  • Fraudulent or illegal activity
  • Non-payment of fees after notice and a reasonable grace period
  • Upon a valid request by law enforcement or government agencies

In cases involving imminent harm to the Service, other Users, or third parties, we may suspend access immediately and provide notice as soon as reasonably possible afterward.

Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We will retain your account data for 30 days after termination, during which you may request an export of your data. After 30 days, we may permanently delete your account data (connected sites, deployment history, workspace associations).
  • Content already deployed to your WordPress sites is not affected by termination of your Deploy Forge account — deployed themes and plugins remain on your sites.
  • The following sections survive termination: Definitions, Intellectual Property, Payment Terms (for outstanding obligations), Limitation of Liability, Disclaimer of Warranties, Indemnification, Dispute Resolution, and General Provisions.

Force Majeure

Neither party shall be liable for any failure or delay in performance resulting from causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government actions, power outages, internet or telecommunications failures, or failures of third-party services (such as GitHub, cloud hosting providers, or payment processors).

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you may terminate your account before the changes take effect.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deploy Forge regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by Deploy Forge.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms to any successor in connection with a merger, acquisition, or sale of assets.

We may provide notices to you via email to the address associated with your account or through the Service. You may provide notices to us at legal@getdeployforge.com.
